SCO Ordered To Pay Novell USD2.5M For Unix Infringements
Judge Kimball asks SCO to pay $2.5 million to Novell for breach of fiduciary and other related charges.
A US district judge Dale Kimball has asked the SCO group to pay Novell a sum of $2.5 million for charges related to unjust enrichment, breach of fiduciary duty, conversion.
Ironically the ruling was made in a case which initiated by the SCO group against Novell for alleged slander of title.
The ruling is part of long drawn legal saga involving SCO which has tried to use its supposed ownership of UNIX to claim rights over the Linux operating system by claiming that the later uses source code originally written for UNIX.
The company then went to initiate legal proceeding against a variety of companies that use Linux including the likes of AutoZone, IBM, and DaimlerChrysler.
However Kimball’s ruling allows both SCO and Novell to appeal against the decision, a fact which is expected to prolong the case even further. Tags: Legal, Novell, copyright, unix
