Ruling in Apple vs. HTC Patent Infringement Case by ITC Scheduled for Next Week

HTC disclosed that the final ruling ordered by US International Trade Commission in the lawsuit against Apple has been postponed and will be delivered next week.

The ruling is expected to be delivered on December 19th - if the ruling is in favour HTC then Apple hardware might be banned during the pre-Christmas season in the US, reports Reuters.

The legal tussle started in March 2010 when Apple filed suit against HTC claiming it copied technologies in the iPhone. Following this, HTC filed its own lawsuit that contended Apple had infringed on their patents.

There have been a lot of ups and downs during the trial. First, at the beginning of this year, the administrative law judge for ITC held that HTC had violated two patents owned by Apple and for final call the case was sent to a six-member panel.

In case Apple wins this case, the International Trade Commission has the power to ban HTC products from shipment to the US. If the ruling favours HTC, the company can continue selling their products in one of the biggest smartphone markets in the world. The outcome of this case is eagerly awaited by both sides.
